FILMING WITH A DRONE IN NYC

As of my last update in January 2022, the regulations regarding filming with drones (Unmanned Aerial Vehicles or UAVs) in New York City are subject to both federal and local laws. Here are some key points to consider:

  1. Federal Regulations: The Federal Aviation Administration (FAA) regulates the use of drones in the United States. This includes rules regarding registration, airspace restrictions, and safety guidelines for drone operations. Filmmakers must comply with FAA regulations when using drones for filming in NYC, regardless of whether they are operating in public or private airspace.

  2. Local Regulations: In addition to federal regulations, New York City has its own set of rules and regulations governing the use of drones. NYC Parks, for example, prohibits the use of drones in parks without prior authorization. Other city agencies may have their own restrictions on drone operations in certain areas.

  3. Permitting Requirements: Depending on the specifics of the filming project, filmmakers may need to obtain permits from both the FAA and local authorities to operate drones in New York City. This may include obtaining a Part 107 Remote Pilot Certificate from the FAA and obtaining permission from NYC Parks or other relevant city agencies for drone operations in parks or other public spaces.

  4. Safety Considerations: Filmmakers must prioritize safety when operating drones in NYC. This includes adhering to FAA regulations, maintaining line-of-sight contact with the drone at all times, avoiding restricted airspace, and taking precautions to prevent accidents or injuries.

  5. Privacy Concerns: Filming with drones may raise privacy concerns, particularly when capturing footage of individuals or private property. Filmmakers should be mindful of privacy laws and regulations and obtain any necessary permissions or releases when filming in areas where privacy may be a concern.

Overall, while it is possible to film with drones in New York City, filmmakers must carefully navigate federal and local regulations, obtain necessary permits and authorizations, prioritize safety, and respect privacy considerations. It's advisable to consult with legal experts and relevant authorities to ensure compliance with all applicable laws and regulations when using drones for filming purposes.
